NBVA Terms and Conditions of Sale
Effective Date: May 2025
1. Acceptance of Terms
By purchasing a ticket, entering an event, or ticking the acceptance box at registration, you agree to be bound by these Terms and Conditions. You further consent to NBVA contacting you for marketing, promotional, and community engagement purposes. You may opt out at any time.
2. Consent to Marketing Communications
By accepting these Terms and Conditions, you consent to receiving communications from NBVA about events, promotions, community programs, volunteering opportunities, and fundraising initiatives via email, SMS, phone, and other electronic messaging services. You may unsubscribe at any time by following the instructions in our communications or contacting us at info@nbva.org.au.
3. Privacy
NBVA is committed to protecting your personal information.
Collection: We collect personal information such as your name, email address, phone number, and payment details when you register for events, purchase tickets, or subscribe to communications.
Use: Your information is used to manage event participation, communicate important event updates, send marketing and community news (with your consent), and improve our services.
Disclosure: We do not sell or rent your personal information to third parties. We may disclose your information to service providers assisting NBVA with event management, IT services, or regulatory obligations, bound by confidentiality.
Security: We implement reasonable security measures to protect your information from misuse, interference, loss, and unauthorised access.
Access and Correction: You have the right to access or correct your personal information by contacting us at [insert contact email].
Complaints: If you have concerns about your privacy, please contact us. If you are not satisfied, you may escalate your complaint to the Office of the Australian Information Commissioner (OAIC).
4. Refunds and Cancellations
Event Cancellation or Rescheduling: NBVA will offer a full refund (including any fees or charges) if an event is cancelled or rescheduled and you are unable or unwilling to attend the rescheduled date.
Withdrawals: Refunds due to participant withdrawal will only be provided where extenuating circumstances exist, supported by a valid medical certificate. A refund request must be submitted no later than 8pm on the day before the event.
Change of Mind: No refunds will be provided for change of mind or personal circumstances not meeting the criteria above.
Event Rejection: If a participant’s application or team entry is not accepted, a full refund will be issued.
Travel and Accommodation Costs: NBVA accepts no liability for costs associated with travel or accommodation booked in connection with events.
Insurance: Participants are encouraged to obtain travel insurance to cover unforeseen cancellations.
5. Variations to Events
NBVA reserves the right to vary event programs, pricing, venues, or participant numbers at its sole discretion, including due to weather conditions, safety considerations, council regulations, or other operational reasons. No compensation other than a ticket refund will be offered for variations.
6. Conditions of Entry
Entry to NBVA events is subject to the following:
NBVA reserves the right to refuse entry or remove individuals who breach these Terms and Conditions or NBVA’s Code of Conduct, appear intoxicated, are under the influence of illicit substances, are inappropriately attired, or behave in a way that disrupts others’ enjoyment.
Late arrivals may be refused entry or participation at NBVA’s discretion.
All participants must comply with any venue rules, health and safety protocols, or lawful directions issued by event staff.
Participants acknowledge that photography and video recordings may occur at events. By attending, you consent to the use of your image for NBVA’s promotional purposes unless you notify NBVA in writing in advance.
7. Liability and Indemnity
NBVA is not liable for personal injury, loss, or damage sustained by participants unless directly caused by NBVA’s proven negligence.
Participants engage in activities at their own risk and are responsible for their personal belongings.
To the maximum extent permitted by law, NBVA excludes all liability for consequential loss.
8. System and Customer Errors
While NBVA takes all reasonable care to ensure that tickets are correctly priced and available, we reserve the right to cancel orders arising from system errors.
Where customer error results in the need to reprocess a transaction, NBVA may recover any costs associated with such reprocessing, including banking fees.
9. Force Majeure
NBVA will not be liable for any delay or failure to perform its obligations under these Terms and Conditions if such delay or failure results from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, or acts of terrorism.
10. Changes to Terms and Conditions
NBVA reserves the right to update these Terms and Conditions at any time. Updates will be effective once published on the NBVA website.
